These Terms of Service ("Terms") govern the provision of freight forwarding, NVOCC, customs brokerage, and related logistics services by Star Trans Logistics ("Company," "we," "us," or "our") to you ("Client," "Shipper," or "you"). By engaging our services or using our website, you agree to be bound by these Terms.
1. Scope of Services
Star Trans Logistics acts as a logistics provider, freight forwarder, and licensed Non-Vessel Operating Common Carrier (NVOCC). We arrange for the transportation of cargo by ocean, air, and inland carriers, and provide customs clearance services as requested. We reserve the right to select and engage third-party carriers, agents, and customs brokers to fulfill these services on your behalf.
2. Client Responsibilities & Declarations
To ensure safe, compliant, and timely transportation, the Client is strictly responsible for:
- Accuracy of Information: Providing complete and accurate commercial invoices, packing lists, weights, dimensions, and cargo descriptions.
- Legal Compliance: Ensuring all shipments comply with the import/export laws and regulations of the origin, transit, and destination countries.
- Packaging & Marking: Ensuring goods are properly packed, stowed, and marked for international transport to withstand ordinary handling.
- Hazardous Materials: Fully declaring any dangerous or hazardous goods in compliance with IMDG, IATA, and DOT regulations prior to booking.
3. Quotations & Rates
Quotations are based on the rates, tariffs, and exchange rates valid at the time of issuance. Quotes are subject to change without notice due to fluctuations in carrier rates, fuel surcharges (BAF/FSC), peak season surcharges (PSS), currency exchange, or dimensional weight recalculations upon actual receipt of the cargo. Quotes do not include customs duties, taxes, or unforeseen storage/demurrage fees unless explicitly stated.
4. Liability & Cargo Insurance
Star Trans Logistics operates under standard industry limits of liability. We are not a carrier and our liability is strictly limited to our role as a freight forwarder/NVOCC.
- Limitation of Liability: Our liability for lost or damaged cargo is governed by our Bill of Lading terms and conditions, international conventions (e.g., COGSA), and tariff rules, which strictly limit monetary compensation.
- Force Majeure: We are not liable for delays, losses, or damages caused by acts of God, strikes, port congestions, weather, war, or governmental actions (including customs holds).
- Cargo Insurance: We strongly highly recommend that all Clients purchase comprehensive all-risk cargo insurance. We can arrange insurance upon written request; standard rates do not automatically include insurance coverage.
5. Payment Terms
Unless otherwise agreed in writing, payment for all services, freight charges, duties, and taxes is due upon receipt of the invoice. Star Trans Logistics reserves the right to withhold release of cargo (exercise a lien) for any unpaid balances. Late payments may be subject to interest charges and collection fees as permitted by law.
6. Governing Law & Jurisdiction
These Terms and any dispute arising from our services shall be governed by and construed in accordance with the laws of the jurisdiction in which Star Trans Logistics' primary office is located, without giving effect to any choice or conflict of law provisions.
